Why Oklahoma City cannot apostille your FBI background check
Oklahoma apostilles are issued by the Secretary of State’s Certification Department at 421 NW 13th Street in Oklahoma City. The office works with two kinds of paper: a notarized original document, or a certified copy of a recorded instrument such as a birth certificate, marriage license or divorce decree.
An FBI Identity History Summary is neither. It is a federal record signed by an FBI official, and federal records are authenticated by the U.S. Department of State Office of Authentications in Washington, DC.
Two points that trip up Oklahoma applicants:
- An OSBI criminal history check is not an FBI check. The Oklahoma State Bureau of Investigation says its records come from the State of Oklahoma only and do not include criminal history from other states. OSBI also states that a national search of FBI records is not available to the public through that agency. A consulate asking for an FBI, federal or national check will not accept an OSBI report in its place.
- Notarizing a printout of the FBI result is the wrong fix. Because the Certification Department apostilles notarial acts, it is tempting to have an Oklahoma notary stamp the FBI PDF and send it in. What comes back is a state certificate on a notary’s signature, attached to a federal record. Foreign immigration offices commonly reject that combination.

- Filing in Washington. We prepare Form DS-4194 and our Herndon, Virginia office hand-carries the request to the Office of Authentications. There is no DOJ certification step. The FBI result goes directly to the Department of State.
