USCIS, MVC and court requirements

  • USCIS. Hudson County is served by the USCIS Newark Field Office at 970 Broad Street, Newark, by appointment. 8 CFR 103.2(b)(3) requires a full English translation certified by the translator as complete and accurate, with the translator’s certification of competence.
  • Motor Vehicle Commission. The MVC requires a certified translation with any identity document not in English. Its published definition accepts a translation from the issuing government, one signed with a seal by a qualified translator, or one from a competent translator over 18 with a certification listing the translator’s name and contact details, the document and applicant names, and statements of fluency, completeness and accuracy.
  • Superior Court, Hudson Vicinage. The Court User Resource Center is in the Hudson County Administration Building, 595 Newark Avenue, Suite 102, Jersey City, NJ 07306, open weekdays 8:30 a.m. to 4:30 p.m. Under the Judiciary’s Language Access Plan the courts supply interpreters at the Judiciary’s cost except in very limited circumstances. Ask the court about written documents before filing.
  • Federal court. The nearest U.S. District Court location is the Martin Luther King Building and U.S. Courthouse, 50 Walnut Street, Newark.

Hudson County Clerk and notaries

The Hudson County Clerk is at 257 Cornelison Avenue, 4th Floor, Jersey City, NJ 07302 (201-369-3470). The office handles passports, notary matters, trade names and county identification cards.

A notary’s role with a translation is limited to notarizing the translator’s signed statement. Under New Jersey law a notary who is not an attorney may not use the title of lawyer or an equivalent term in any language, and one who advertises must disclose, in the language of the advertisement, that he or she may not give legal advice about immigration or any other legal matter.

From Jersey City to a New Jersey apostille

New Jersey apostilles are issued only in Trenton, by the Department of the Treasury, Division of Revenue and Enterprise Services. There is no Hudson County counter for them, and Treasury’s instructions do not describe a county clerk step.

You place the order through the state’s online apostille service, then mail the confirmation and documents to PO Box 452, Trenton, NJ 08646 for standard service ($25 per document, 12 to 20 business days) or deliver them to 33 West State Street, 5th Floor, Trenton for expedited service ($40 per document, 8.5 business hours from receipt). A service fee of $2.50 by card or $1.00 by e-check applies.

For vital records, Treasury points applicants to copies from the State Office of Vital Statistics and Registry for events from 1923 forward, so confirm with Treasury before sending a City Clerk copy. For a non-English document, Treasury recommends a notarized English translation and issues two apostilles for two fees. When that notarization is needed, we hire a notary commissioned in New Jersey to notarize the translator’s statement.
