Why Helena cannot apostille your FBI background check
Montana apostilles are issued by the Notary & Certifications Division of the Secretary of State’s Office, in the State Capitol in Helena. The division certifies documents for foreign use that carry the signature of a Montana notary public or other authorized notarial officer, along with certified Montana records.
Its apostille page is direct about federal paperwork. It states that the Montana Secretary of State’s office cannot certify FBI background checks and points applicants to the FBI and the Department of State Office of Authentications. Certified documents from federal agencies, it says, should be authenticated by the U.S. Department of State.
Two things Montana clients get wrong:
- A Montana Department of Justice background check is a different document. The Criminal Records and Identification Services Section in Helena runs name-based checks online or by mail, and its mail-in fingerprint check is labeled non-federal and state only. A consulate that wrote “FBI”, “federal” or “national” on its checklist is not asking for that report.
- Notarizing the FBI PDF to make it fit Helena’s rules. Because the Secretary of State certifies notarized documents, some applicants have a notary stamp a printout of the FBI result. What comes back is a state certificate on a notary’s signature, not a federal apostille on the FBI record, and foreign immigration offices usually refuse it.
For Montana birth certificates, marriage records or notarized documents, see state apostille services.
How it works from Montana
- Get fingerprinted near home. Ask a police department, sheriff’s office or fingerprinting vendor for an ink FD-1164 card, or register on the FBI’s eDO site and have prints taken electronically at a participating U.S. Post Office. Then request your FBI Identity History Summary. The FBI fee is $18.
- Wait for the FBI. The result is a PDF carrying the FBI watermark and the signature of a division official.
- Email us the PDF. We compare the name and date of birth with your passport before anything is filed, so send the passport photo page too.
- Hand delivery in Washington. We prepare Form DS-4194 and our Herndon, Virginia office carries the request to the Department of State Office of Authentications. There is no DOJ certification step. The FBI result goes straight to the Department of State.
- Return shipping. FedEx to your Montana address, or FedEx or DHL directly to the country you are moving to.
We have no office in Montana and do not take fingerprints there. Our work starts once you have the FBI PDF.

Where we serve Montana clients
Every county, because the whole service runs on email and FedEx. Clients write to us from Billings, Missoula, Great Falls and Bozeman, from Butte and Helena, and from the Flathead Valley towns of Kalispell and Whitefish. The process is identical for someone in Havre or Miles City. Nobody has to drive to the Capitol, and nothing needs to be dropped off in person.
In a state this large, plan the fingerprinting step first. Check which nearby agency or post office takes prints before you set a consulate date, since that is the one part of the process that happens in person.
Why Montanans need an apostilled FBI check
Common destinations for our Montana clients include Mexico, Costa Rica and Panama for retirement and residency, and Spain and Portugal for long-stay and non-lucrative visas. South Korea and Japan ask for an apostilled FBI check with teaching and work visas, a frequent request from recent graduates in the university towns of Missoula and Bozeman. Italy requires it for citizenship and residency files, and Australia and Germany come up for work permits.
Spanish, Portuguese, Italian and Korean authorities generally expect a translation with the apostilled document. Certified translation can be ordered at the same time. Many authorities only accept an FBI check issued within the last 3 to 6 months, so do not get fingerprinted too early.
The full federal process is explained on our FBI apostille services page.
FAQ
Can the Montana Secretary of State apostille an FBI background check?
No. The Notary & Certifications Division in Helena states that it cannot certify FBI background checks. Federal agency documents are authenticated by the U.S. Department of State in Washington, DC.
How long does an expedited FBI apostille take for Montana residents?
10 business days from the day we receive your FBI result. Standard service takes 7–8 weeks.
Will a Montana Department of Justice background check work instead?
Only if the foreign authority asked for a state check. The Montana DOJ report is a state record. A request for an FBI or national check needs the FBI Identity History Summary.
I live in Billings or Kalispell. Do I have to travel to Helena?
No. Helena has no role in an FBI apostille, and we have no Montana office to visit. You email the FBI PDF and the apostille comes back by FedEx.
Can you ship the apostille overseas if I have already left Montana?
Yes. We send by FedEx or DHL to an address abroad, and the FBI PDF can be emailed to us from anywhere.
