Immigration filings and the federal translation rule

8 CFR 103.2(b)(3) says any document containing foreign language submitted to USCIS shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator’s certification of competence to translate from the foreign language into English. Notaries, 'notarios' and translations in Florida

Florida law draws a firm line here. Section 117.05 of the Florida Statutes prohibits a literal translation of the phrase ‘Notary Public’ into another language in an advertisement for notarial services, and bars a notary who is not authorized to represent people in immigration matters from advertising as a notario publico, notario, immigration assistant, immigration consultant or immigration specialist.

The Florida Department of State adds that the person translating a document cannot be the person who notarizes it. When a translator’s statement needs a Florida notarization, we hire a Florida notary, who is a different person from the translator.

Schools and colleges
